Terms and Conditions

This Rental Agreement includes important terms regarding rental equipment, assumption of risk, release of liability, customer responsibilities, damage, cleaning, weather-related safety, delivery, pickup, and use of equipment. Please read this Agreement carefully before signing.

1. RENTAL & DELIVERY

This Agreement applies to all rental equipment, accessories, and services identified on the associated quote, invoice, or rental order ("Invoice"). The Invoice is incorporated into and made part of this Agreement. In the event of a conflict, this Agreement controls unless otherwise stated in writing.

Equipment will be delivered to the address specified by the Customer. The Customer grants Chavez Event Rentals LLC, its employees, and authorized representatives reasonable access to the property for delivery, setup, inspection, pickup, and removal of rental equipment at or around the scheduled delivery and pickup times.

The Customer is responsible for ensuring that the delivery area is accessible, safe, clear of obstacles, and suitable for the rented equipment. Chavez Event Rentals LLC reserves the right to refuse delivery or setup if the location is unsafe, inaccessible, or does not meet the requirements for the rented equipment.

2. ASSUMPTION OF RISK

I understand that the use of rental equipment, including but not limited to inflatables, water slides, bounce houses, canopies, tables, chairs, swamp coolers, patio heaters, games, concession equipment, and related accessories, involves inherent risks that cannot be completely eliminated.

These risks may include, but are not limited to, falls, slips, trips, collisions, burns, weather-related hazards, equipment misuse, and other accidents that may result in injury, illness, emotional distress, death, or property damage.

I voluntarily assume all ordinary risks associated with the use of the rented equipment and accept responsibility for my own safety and the safety of all participants, guests, and invitees during the rental period.

3. EQUIPMENT RESPONSIBILITY

The Customer accepts full responsibility for all rental equipment and accessories from the time of delivery until pickup by Chavez Event Rentals LLC.

The Customer agrees not to move, alter, dismantle, relocate, sublease, loan, or allow unauthorized persons to modify or relocate any rental equipment.

Only Chavez Event Rentals LLC is authorized to install, relocate, dismantle, or remove rental equipment unless prior written authorization has been provided.

The Customer is responsible for all accessories supplied with the rental, including, where applicable, blowers, extension cords, GFCI adapters, water hoses, hose splitters, stakes, sandbags, ratchet straps, tie-down straps, tarps, safety mats, covers, hardware, and other supplied accessories.

4. DAMAGE, LOSS, THEFT & MISSING EQUIPMENT

The Customer agrees to return all rental equipment and accessories in substantially the same condition in which they were delivered.

The Customer is financially responsible for any loss, theft, vandalism, misuse, negligence, unauthorized relocation, pet damage, fire damage, flood damage, cuts, rips, tears, punctures, burns, stains caused by misuse, or other physical damage to equipment or accessories occurring during the rental period, whether caused by the Customer, guests, family members, or other attendees.

The Customer agrees to pay the reasonable cost of repair or replacement when applicable.

5. CLEANING FEE

Rental equipment must be returned in a clean condition and substantially the same condition in which it was delivered.

Equipment must be free of excessive dirt, mud, food, drinks, gum, candy, confetti, glitter, silly string, face paint, pet waste, bodily fluids, smoke residue, or other debris requiring cleaning beyond normal post-rental maintenance.

Chavez Event Rentals LLC reserves the right to assess a reasonable cleaning fee when equipment requires cleaning beyond normal post-rental maintenance due to excessive dirt, debris, spills, stains, or other mess caused during the rental period.

Any cuts, rips, tears, punctures, burns, or other physical damage are not considered normal wear and tear and may result in repair or replacement charges under the Damage, Loss, Theft & Missing Equipment section of this Agreement.

Ordinary dust and reasonable use will not result in a cleaning fee.

6. WEATHER ACKNOWLEDGMENT

The Customer understands that weather conditions may change rapidly and agrees to immediately discontinue use of rental equipment when unsafe conditions develop, including but not limited to lightning, thunder, strong or gusty winds, heavy rain, flash flooding, dust storms (haboobs), or any other hazardous weather conditions.

Chavez Event Rentals LLC may require equipment to be shut down or may retrieve equipment when conditions become unsafe.

Safety takes priority over continued use of the equipment.

7. SAFETY RULES & SUPERVISION

The Customer agrees to use all rental equipment safely and only for its intended purpose.

The Customer will provide responsible adult supervision where appropriate and ensure that all participants follow the safety instructions provided by Chavez Event Rentals LLC.

For inflatable equipment, the following rules apply:

1. Follow all safety rules and operating instructions provided with the inflatable.
2. A responsible adult must supervise the inflatable whenever it is in use.
3. In the event of high winds, storms, lightning, or other unsafe weather, immediately remove all participants and discontinue use.
4. Remove shoes, eyeglasses, jewelry, and sharp objects before entering.
5. No food, drinks, gum, candy, silly string, confetti, glitter, or other substances that may damage or excessively soil the inflatable.
6. No flips, somersaults, wrestling, rough play, piling on, or intentional collisions.
7. Do not climb on walls, nets, posts, or other portions of the inflatable not intended for climbing.
8. Do not bounce against walls, corner posts, or entrances.
9. Do not jump or sit on entrance ramps.
10. Do not jump from the top of a slide.
11. Riders should be of similar size when required by the equipment's posted safety guidelines.
12. Never exceed the manufacturer's posted rider capacity or weight limits.
13. Do not allow the inflatable to rub against structures, trees, fences, vehicles, or other surfaces.
14. Do not move the inflatable after setup.
15. Water may only be used with equipment specifically designed and approved for water use.
16. Individuals with head, neck, or back injuries, pregnant individuals, small infants, or others who may be particularly susceptible to injury from falls, bumps, or bouncing should not use inflatable equipment.
17. If an inflatable begins to deflate, all riders must exit immediately.
18. If the blower stops, check the power connection and circuit breaker.
19. If the blower continues running but the unit is losing air, check the blower intake and air tubes.
20. If the problem cannot be corrected safely, discontinue use and contact Chavez Event Rentals LLC.

For water slides and other water equipment, follow all manufacturer instructions and additional safety instructions if provided by Chavez Event Rentals LLC. Water equipment must not be used during unsafe weather conditions.

8. RELEASE OF LIABILITY & INDEMNIFICATION

To the fullest extent permitted by Arizona law, I release, waive, and discharge Chavez Event Rentals LLC, its owners, members, employees, and agents from claims arising out of the ordinary use of the rented equipment, except to the extent caused by gross negligence, willful misconduct, or where liability cannot legally be waived.

I agree to indemnify and hold harmless Chavez Event Rentals LLC from claims, damages, losses, or expenses arising from my use of the rented equipment or the acts or omissions of my guests or invitees.

9. INSURANCE

I acknowledge that I have adequate homeowner's insurance, renter's insurance, or other applicable liability insurance to cover bodily injury or property damage that might occur to myself, my guests, or my invitees from the use of the rented equipment, or I agree to bear the costs of such injury or damage myself.

10. CUSTOMER RESPONSIBILITY

The Customer agrees to supervise the equipment and its use at all times while the equipment is in the Customer's possession.

The Customer agrees to follow all operating instructions, safety rules, warnings, and instructions provided by Chavez Event Rentals LLC and/or the equipment manufacturer.

The Customer understands that failure to follow these requirements may result in injury, property damage, equipment damage, additional charges, or termination of use.

11. AGREEMENT ACKNOWLEDGMENT

By signing this Agreement, the Customer acknowledges that they have carefully read this Agreement, have had the opportunity to ask questions, fully understand its contents, and voluntarily agree to all of its terms.

The Customer understands that this Agreement is binding upon the Customer and, to the extent permitted by law, the Customer's heirs, personal representatives, successors, and assigns.

Electronic signatures shall have the same legal effect as handwritten signatures.

12. GOVERNING LAW

This Agreement shall be governed by the laws of the State of Arizona. Any legal action arising from this Agreement shall be brought in a court of competent jurisdiction in Arizona, to the extent permitted by applicable law.

If any provision of this Agreement is found to be void or unenforceable, the remaining provisions shall remain in full force and effect.
